Terms of Service

1. The Service

Persians Home is a directory and advertising platform that allows business owners, event organizers, and property advertisers to create and promote listings. We are not a marketplace and do not accept customer payments on behalf of merchants, and we are not a broker or agent for any property advertised here. We sell our own advertising/subscription plans to the people who list with us.

2. Eligibility & Accounts

You must be at least 18 and able to form a contract. Keep your credentials secure and notify us of any unauthorized use. You are responsible for activity under your account.

3. Subscriptions, Billing, Refunds, Taxes

• Paid plans (e.g., Silver/Gold) renew monthly or annually until canceled.
• You authorize recurring charges via Stripe.
• ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE. No refunds will be provided under any circumstances, including but not limited to change of mind, technical issues, service dissatisfaction, or unused services.
• By making any payment, you explicitly acknowledge and agree to our no-refund policy. Nothing in these Terms affects any right you may have to dispute a charge with your card issuer, bank, or payment provider.
• You are responsible for applicable taxes; prices may change on notice.
• If you believe a charge is incorrect, please contact us at info@persianshome.com first — billing questions are usually resolved faster that way than through your bank.
• We may suspend or remove advertising services on an account that carries an unpaid or reversed balance until that balance is settled.

4. User Content & License

You retain ownership of content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute such content to operate and promote the Service. You represent you have all rights to your content and that it does not violate law or third-party rights.

5. Prohibited Conduct/Content

• No illegal, infringing, deceptive, hateful, pornographic, or violent content.
• No harassment, malware, scraping, or attempts to bypass security.
• No spam/fake reviews or promotion of restricted/high-risk goods/services.
• No use from sanctioned jurisdictions, including Iran.

6. Third-Party Services

Payments are processed by Stripe; maps and other components may be provided by third parties. Their terms and privacy policies apply to their services.

7. Availability and Changes

We may modify, suspend, or discontinue the Service at any time. We aim for high availability but do not guarantee uninterrupted access.

8. Disclaimers

The Service is provided AS IS and AS AVAILABLEwithout warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and those arising from course of dealing or usage.

8.1. False Information and User-Generated Content Disclaimer

IMPORTANT: We are not responsible for any false, inaccurate, misleading, or fraudulent information displayed on our map, directory, or application. All business listings, event information, property listings, contact details, addresses, hours of operation, prices, and other content are provided by users and third parties.

• We do not verify, endorse, or guarantee the accuracy of any information provided by users, including business names, addresses, phone numbers, hours, services, event dates, asking prices, rents, availability, or any other details.
• Users are solely responsible for the accuracy and truthfulness of all information they submit.
• We disclaim all liability for any damages, losses, or consequences arising from reliance on false, inaccurate, or misleading information displayed on our platform.
• Map locations and addresses may be approximate or incorrect. Users should verify information directly with the business, organizer, or property advertiser before visiting or making decisions.
• We reserve the right to remove or modify any content that we determine to be false, misleading, or inappropriate, but we are under no obligation to do so.
• Third-party integrations (maps, payment processors, etc.) may contain their own inaccuracies for which we are not responsible.

8.2. Verification and Claims

While we may offer verification features, we do not guarantee the legitimacy, ownership, or authorization of any business, event, or property, or of any individual claiming to represent one — including anyone advertising a property they do not own or are not authorized to advertise. Users should exercise caution and verify credentials independently.

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive damages, or lost profits. Our total liability for any claim shall not exceed the amounts you paid to us in the 12 months preceding the claim (or $100 if none).

10. Indemnity

You will indemnify and hold harmless Persians Home from claims arising out of your content, your use of the Service, or your violation of these Terms or applicable law.

11. Termination and Business Discontinuation

Business Discontinuation: We reserve the right to discontinue the Service at any time for any reason, including but not limited to financial, technical, or business reasons. In the event of Service discontinuation:

• No refunds will be provided for any unused portion of prepaid services.
• Users acknowledge that all payments are final and non-refundable regardless of Service discontinuation.
• We will provide 30 days advance notice of Service discontinuation when possible.
• Users waive any right to claim damages, refunds, or compensation for Service discontinuation.

Account Termination: You may cancel at any time; we may suspend or terminate accounts for violations, fraud, or legal reasons. Sections intended to survive termination will continue to apply.

12. Force Majeure and Business Risks

We are not liable for any failure to perform due to circumstances beyond our control, including but not limited to: business failure, financial difficulties, market conditions, regulatory changes, or other force majeure events. Users assume all risks associated with prepaid services and acknowledge that business operations may cease at any time.

13. Governing Law; Venue

These Terms are governed by the laws of the State of California. Exclusive venue and jurisdiction lie in the state or federal courts located in Los Angeles County, California.

14. Binding Arbitration; Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by binding arbitration administered by JAMS pursuant to its Streamlined Arbitration Rules, in English, before a single arbitrator, seated in Los Angeles County, California. Judgment on the award may be entered in any court of competent jurisdiction. You and we waive any right to a jury trial or to participate in a class or representative action. Notwithstanding the foregoing, either party may bring an individual action in small claims court or seek injunctive relief for misuse of intellectual property, fraud, or unauthorized access.

15. DMCA

If you believe content on the Service infringes your copyright, notify us at info@persianshome.com with: your contact details, identification of the work, the URL(s) at issue, a statement under penalty of perjury, and your physical/electronic signature.

16. Changes

We may update these Terms; the updated date will appear above. Material changes will be notified where appropriate. Continued use after changes become effective constitutes acceptance.
